General Conditions Of Carriage

PREAMBLE

Flights marketed under the Fly2Galicia brand are marketed by AVIATION & MOBILITY SERVICES GROUP, S.L., Tax ID B26630483, with registered office at Plaza de la Quintana 3, 15704 Santiago de Compostela, Spain.

Fly2Galicia may contract duly licensed air carriers to operate its flights.

Passengers will be informed of the identity of the operating air carrier in accordance with applicable law.

Where a flight is operated by FLYYO S.R.L., FLYYO shall act as the operating air carrier and the air carriage shall be subject to FLYYO’s applicable General Conditions of Carriage, the relevant charter/wet lease agreement and applicable legislation.

Where these commercial conditions conflict with mandatory operational or safety requirements imposed by the operating carrier, mandatory law and the operating carrier’s lawful safety instructions shall prevail within the carrier’s responsibilities.

  1. DEFINITIONS

Operating Air Carrier: the airline actually performing the flight.

Fly2Galicia: the commercial brand used by Aviation & Mobility Services Group, S.L. to market the relevant services.

Passenger: any person, other than crew members, carried or to be carried pursuant to a confirmed booking.

Baggage: personal property accompanying a passenger, including checked and unchecked baggage.

Cabin Baggage: baggage retained by the passenger during the journey subject to applicable restrictions.

Checked Baggage: baggage delivered into the custody of the carrier for carriage in the aircraft hold.

Travel Documents: passports, identity documents, visas, permits, certificates or other documentation required for travel.

Convention: any international convention applicable to the carriage, including the Montreal Convention 1999.

  1. APPLICABILITY

These Conditions apply, as appropriate, to flights marketed under the Fly2Galicia brand.

Where transportation is performed under a charter or wet lease arrangement, the operating carrier’s General Conditions of Carriage apply in accordance with the relevant agreement.

Mandatory applicable law shall prevail over any inconsistent provision.

  1. CHECK-IN AND BOARDING

Passengers must complete check-in within the deadlines communicated for their flight.

Online check-in will generally be available from 7 days until 4 hours before departure.

Airport check-in will normally close 40 minutes before scheduled departure.

Passengers must arrive at the boarding gate within the stated deadline.

The operating air carrier may refuse boarding to passengers who fail to meet the applicable deadlines.

  1. REFUSAL OR LIMITATION OF CARRIAGE

The operating air carrier may reasonably refuse to carry a passenger or baggage where necessary, including:

  • compliance with applicable laws or government requirements;
  • operational safety or security;
  • risk to the aircraft, crew or passengers;
  • intoxication presenting a safety risk;
  • aggressive, threatening or seriously disruptive behaviour;
  • refusal to undergo security screening;
  • failure to follow safety instructions;
  • inadequate travel documentation; or
  • dangerous, unsuitable or non-compliant baggage.

Operational safety and acceptance decisions fall within the authority of the operating air carrier and aircraft commander as provided by law.

  1. SPECIAL ASSISTANCE

Passengers requiring assistance should notify Fly2Galicia within the applicable advance-notice period.

Certain medical equipment, mobility devices or other special items may be subject to operational and safety requirements.

Passengers with disabilities or reduced mobility retain all rights granted under applicable legislation.

  1. BAGGAGE

The applicable baggage allowance is shown in the booking and depends on the fare purchased.

Where included, cabin baggage may consist of one item up to 8 kg and 55 × 40 × 20 cm and one personal item up to 40 × 30 × 20 cm.

Cabin space cannot be guaranteed in every circumstance. Items may be placed in the hold where required for capacity, operational or safety reasons.

Checked baggage generally included:

Economy Premium: 1 × 20 kg.
Business Premium: 2 × 20 kg.

Additional charges may apply to excess weight, size or number of items.

Passengers must not carry items prohibited by aviation security legislation or dangerous-goods rules.

  1. BAGGAGE INSPECTION

Baggage may be inspected by the carrier, airport or competent authorities for security purposes.

Passengers must cooperate with required inspections.

  1. ANIMALS

Carriage of animals is subject to prior approval, availability and applicable conditions.

Passengers are responsible for all veterinary certificates, vaccinations, entry permits and other required documentation.

Recognised assistance dogs will be handled in accordance with applicable legislation.

  1. SCHEDULES AND OPERATIONAL CHANGES

Fly2Galicia and the operating carrier will use reasonable efforts to perform carriage according to the published schedule.

Where operationally necessary, schedules, aircraft or, where legally permissible, the operating carrier may be changed.

Passengers affected by significant changes will be contacted using the information available in their booking.

  1. CANCELLATIONS, DELAYS AND DENIED BOARDING

Where Regulation (EC) No 261/2004 applies, passengers may be entitled to care, reimbursement, rerouting and/or compensation depending on the circumstances.

Entitlements depend on factors including flight distance, length of delay, notification of cancellation and extraordinary circumstances.

Nothing in these Conditions limits mandatory passenger rights.

For charter/wet lease operations, operational responsibilities between Fly2Galicia and the operating carrier may be allocated under their underlying agreement without prejudice to statutory rights held directly by passengers.

  1. CONDUCT ON BOARD

Passengers must comply with crew instructions at all times.

Conduct that endangers the aircraft or its occupants, interferes with crew duties, threatens or harasses others, damages property or breaches applicable smoking, alcohol or electronic-device rules is prohibited.

The aircraft commander may take reasonably necessary measures to preserve safety and order.

  1. TRAVEL DOCUMENTS AND FORMALITIES

Passengers are responsible for holding all documents required to enter, leave or transit relevant countries.

Passengers must comply with security, immigration, customs and other official controls.

  1. CARRIER LIABILITY

Liability arising directly from air carriage rests with the operating air carrier in accordance with the Montreal Convention 1999, applicable European Union legislation and other applicable law.

Where FLYYO operates the flight, the liability provisions contained in FLYYO’s applicable General Conditions of Carriage shall apply insofar as compatible with mandatory law.

No contractual limitation shall restrict liability where mandatory law prohibits such limitation.

  1. LOST, DELAYED OR DAMAGED BAGGAGE

Baggage irregularities should be reported immediately at the airport to the relevant carrier or ground-handling service.

Passengers should retain their Property Irregularity Report (PIR) and supporting documentation.

Claims must be submitted within the applicable time limits under the Montreal Convention and other applicable legislation.

  1. ADDITIONAL SERVICES

Additional services may be supplied by Fly2Galicia or by third parties.

Where a third party provides a service, that provider’s terms may also apply.

Commercial complaints concerning bookings made through Fly2Galicia may be addressed to:

Claims concerning matters for which the operating air carrier is legally responsible may be forwarded to, or may need to be submitted directly to, that carrier in accordance with applicable law.

  1. GOVERNING LAW AND JURISDICTION

The commercial relationship between Fly2Galicia and its customers is governed by Spanish law, without prejudice to mandatory consumer-protection rules.

The liability of the operating air carrier and jurisdiction relating to air carriage shall be determined in accordance with the Montreal Convention, European Union law and other applicable legislation.
